Terms & Conditions

• If you submit our refer-a-friend submission form (“Submission Form”) you shall be deemed to have accepted these Terms and Conditions.
• You may refer individuals and businesses.
• If you are a current subscriber to our services, your account must not be in debit and no Commission (as defined in paragraph 7) shall be payable unless and until your account is no longer in arrears.
• You must input correct contact details for yourself when you fill out our form. In particular, you must provide us with a valid email address. No referral shall be processed if we, in our discretion, consider the submission to be inaccurate or malicious or if no valid email address is provided.
• You consent to us giving your name to the friend whom you have referred to us. You also consent to us releasing any details provided by you should we be requested to do so by any governmental body, including but not limited to the Advertising Standards Agency.
• If your friend signs up to any of our services as a direct result of your referral and our subsequent email to them, we shall pay to you 10% of the first year’s subscription revenue paid by your friend to us (“Commission”). This shall be limited to the amount actually received by us and no Commission shall be payable on any unpaid subscription fees.
• Your friend must sign up for one of our services within 6 months of the date on which you submit the referral. Where your friend signs up after this period, we reserve the right, in our sole discretion, to decide whether or not to pay the Commission.
• Where more than one person refers the same friend, the person whose Submission Form was submitted first shall be entitled to the Commission.
• The Commission shall be payable by way of cheque, which shall be made payable to the person or company entered into the Submission Form as the referrer. Please take care to ensure that your Submission Form is correctly filled out. We fully reserve the right to refuse to change the name of the recipient of the cheque. We may, in our discretion chose to pay via a different method, including, where you are a current customer, by off-setting the Commission against your subscription fees. Cheques shall be sent to the address detailed on the Submission Form unless you contact us to provide us with a new address.
• We shall send you your Commission cheque within 30 days of the end of the first year of your friend’s subscription.
• If you do not bank your cheque within 3 months of us sending this to you, your Commission will be forfeited and we shall in our absolute discretion decide whether or not to re issue a further cheque for the Commission.
• This scheme may be withdrawn by us at any time but we will pay any Commission arising on submissions made before the withdrawal of this scheme.
• All information collected by us about you and your friend remains our property and shall not be transferred to third parties and will be used and processed by us in accordance with our privacy policy. You must ensure that your friend is happy for their details to be passed to us and, by submitting the Submission Form, you undertake to us that you have obtained this consent.
• You undertake to us that the submission of your friend’s details will not result in a breach by you of any confidentiality, non-solicitation or other contractual or common law duties to which you are subject. Should this undertaking be found to be untrue, you fully indemnify us and shall keep us indemnified from any loss we may suffer as a result of this.
• We fully reserve the right not to contact your friend.
• The promoter of this scheme is Engage Software Limited trading as EngageSciences, a private limited company incorporated in England and Wales with registered number  07101974 and whose registered office address is at 99 Milton Park, Abingdon, OX14 4RY, United Kingdom.
